Copyright and Use Policy

1. Copyright ownership

All architectural works, including but not limited to floor plans, blueprints, drawings, designs, and related  digital and printed materials, are the exclusive property of Smart Start Homes LLC, and are protected by United States and international copyright law. The purchase of a house built by Smart Start Homes LLC  transfers no ownership of the copyright to the buyer. 

2. Permitted use

Contractors hired by Smart Start Homes LLC may use the plans one time to construct that specific  home. Building more than one home from a single plan is a copyright infringement.

3. Prohibited actions

The following actions are strictly prohibited and constitute a violation of copyright:

• Copying and reproduction: You may not copy, duplicate, or reproduce the plans in whole or in part without the prior written consent of Smart Start Homes LLC. This includes taking the plans to a copy shop or blueprinter for unauthorized copies.
• Modification and redrawing: You may not modify, adapt, or create derivative works from the plans. The original designer retains the copyright to the original work and any modified version.
• Using derivative works: Reproducing, selling, or reusing a modified design is prohibited without express permission from Smart Start Homes LLC.
• Copying existing homes: It is illegal to copy or redraw a constructed home that is protected by copyright, even if you have never seen the original plans.

4. Responsibility for infringement

Any party who participates in a copyright violation is responsible, regardless of whether they were aware  of the infringement. This includes purchasers, homeowners, builders, contractors, and copy shops.  Ignorance of the law is not a valid defense. 

5. Penalties for infringement

Penalties for violating this copyright policy can be severe and may include: 

Payment of the copyright owner's actual damages.

• Payment of any profits made by the infringer.
• Statutory damages, which can be as high as $150,000 for each infringement.
• Payment of the copyright owner's legal fees.
